สำหรับกรณีที่คนต่างด้าวเข้ามาทำงานในประเทศไทยตามระบบการนำเข้าแบบ MOU โดยการนำเข้าของผู้รับอนุญาตให้นําคนต่างด้าวมาทํางาน (บริษัทนำคนต่างด้าวมาทำงานในประเทศ) เมื่อคนต่างด้าวนั้นออกจากงาน นายจ้างที่จ้างคนต่างด้าวจะต้องแจ้งให้ผู้รับอนุญาตฯ และกรมการจัดหางานทราบภายใน 7 วันนับตั้งแต่วันที่คนต่างด้าวออกจากงาน พร้อมทั้งระบุเหตุแห่งการออกจากงานของคนต่างด้าวนั้นด้วย
นอกจากนี้ ก่อนคนต่างด้าวเข้าทํางานกับนายจ้างตามระบบการนำเข้า MOU นายจ้างต้องจัดทําสัญญาจ้างเป็นหนังสือ โดยมีรายการอย่างน้อยตามที่อธิบดีกําหนด และเก็บสัญญาจ้างงานไว้ ณ ที่ทําการของนายจ้างเพื่อให้นายทะเบียนหรือพนักงานเจ้าหน้าที่สามารถตรวจสอบได้ และสําเนาสัญญาจ้างดังกล่าวเพื่อให้ลูกจ้างเก็บรักษาไว้
